Bankruptcy Can Give You a Fresh Start

Bankruptcy is a great option for many of our clients, but we don’t sell bankruptcy. The most important thing is to find out what’s right for you and your family. Maybe that’s bankruptcy. Maybe it isn’t. So it’s not always a matter of what chapter you’ll file–usually Chapter 7 or Chapter 13–it’s a matter of whether you should file in the first place.

What Our Clients Say

Types of Bankruptcy Cases We Handle

Bankruptcy is an old concept. It’s in the Constitution. In fact, the concept of discharging debt goes back to the Old Testament. Western civilization has realized for thousands of years that being trapped in debt is a bad thing. It really doesn’t help anyone, even creditors.

Chapter 7

Chapter 7 is often called a “fresh start” bankruptcy. It’s designed for people who feel buried by credit cards, medical bills, or loans they simply can’t pay back.

In most cases, you can wipe out those debts completely and keep the things you need (like your car, home, and personal belongings). If you’re looking for a clean break from debt and a chance to rebuild, Chapter 7 may be the quickest path forward.

Chapter 13

Chapter 13 lets you keep your home, car, and other assets while reorganizing debt. You make one monthly payment through a court-approved plan over three to five years. It stops foreclosure, collections, and gives you time to catch up.

Debt Settlement

Debt settlement avoids bankruptcy by negotiating directly with creditors. We work to reduce the total balance and arrange a payment schedule you can afford. It’s a way to resolve debt without going to court.

We'll help you determine if bankruptcy is right for you.

If it’s not, we’ll discuss other options like a debt management plan with a reputable non-profit like Family Services of Charleston. And for some clients debt settlement—negotiating directly with creditors—is the option we recommend.
